Advertising Terms of Service

This is version 3.6 of the Terms of Service that cover our provision of advertising and related services, and was last updated on November 15, 2025.  This document will be updated any time we make changes to it.  Your engaging us to provide such services is conditional upon your acceptance of these terms of service.

Protection from Policy/Rate Changes
Station (Bay and Beyond Broadcasting LLC and/or any of the radio stations and internet streams owned by Bay and Beyond Broadcasting, as the context requires) reserves the right to revise advertising policies at any time.  Advertisers receive 60 day protection from any policy changes, and if the policy changes are unacceptable, may cancel without penalty the balance of their advertising from when the new policy is to take effect.

Station guarantees the quoted rates for the period of this contract as long as Advertiser remains current with payments.

Right of Refusal
Station reserves a continuing right at all times to refuse any advertisement for any reason.  Station does not discriminate in advertising contracts on the basis of race or ethnicity.  Any provisions in any order or agreement for advertising that purports to discriminate on the basis of race or ethnicity, even if handwritten, typed, or otherwise made a part of a particular contract, is hereby rejected.  If an advertisement is refused, no charge shall be made for the refused ad and any prepayments shall be either applied to other outstandings or, if none, either held on account or returned to the Advertiser (Advertiser’s choice).  By way of example but not limitation, Station does not accept advertising which it considers discriminatory or indecent or grossly offensive to listeners and other advertisers, or harmful to its image as a community supporter and leader, or of unacceptable or incompatible technical or production quality.

Provision of Materials, Approvals, and Leadtimes
We produce advertisements in house at no extra charge, or coordinate external ad production at extra cost.  In house ads feature the voice of one of our staff, optional background music, and occasionally a sound effect.  Upgraded music and other options are available at extra cost.

If Advertiser is supplying produced/recorded advertisements, such shall be supplied at least one business day in advance of scheduled run times (ie ads to start on Wednesday must be received by end of Monday), via email or a “Drop Box” type service (ie not on a USB “thumb drive”).  If Station is creating advertisements for Advertiser, the information and instructions from Advertiser shall be supplied at least three business days in advance of scheduled run times.  If materials are not received within this time frame, or if Advertiser delays approvals, Station may not have sufficient time to create and/or to reschedule the advertisements, and any such ads not run due to late submissions shall remain payable to Station.

If Advertiser wishes to record their own advertisements, they should either send a good quality audio recording or record their audio in our studios.  We allow ten minutes of studio time per ad recorded, additional studio rental and operator time is $25 per each ten minutes.

Any changes to advertisements have the same lead time requirements as new advertisements.

Station will supply via email a script if the advertisement is to be read, verbatim, live, or a set of guidelines if announcers are to ad lib, and subsequently an audio file of any pre-recorded advertisement they are creating, and Advertiser can request changes if wished.  The advertising deadlines assume approvals within a half business day.

Pre-recorded advertisements must not exceed the agreed time length, and must be in a style similar to other advertisements.  Advertiser-supplied copy must also allow for the agreed length.

Revisions
Once approved by Advertiser, all changes shall incur a change fee of not less than $25 per change per ad.

Advertising Pauses/Holds
Advertiser may request a temporary hold on advertising, with the same three business day lead time applying for the hold to start.  Such holds will not last longer than three weeks; at which point, if extended further, the hold shall become a cancellation (as per the clause on cancellations).

Cancellation
Advertiser may cancel the unaired balance of this contract at any time, with such request to be in writing.  It may take up to three business days for Station to update their log files and to delete the advertisements.  In the event of any cancellation or reduction in advertisements played, any negotiated quantity discounts or other inducements / incentives, which are always based on the assumption of a full contracted run of advertising, shall be annulled and the higher standard rate sheet rates shall apply to all advertising provided.  Cancellations must be made and confirmed in writing.

Rights and Compliance
Advertiser warrants that it has all required rights for the material it is providing to Station and Station warrants it has all required rights for any materials it creates or provides as part of producing advertisements.  Both parties warrant to the other that the advertisements comply with all applicable industry regulations applicable to each warranting party.  Both parties agree to indemnify and hold harmless the other from the use of any such materials by the other party.

Make-Good Ads
In the event of any advertisements not broadcast, Station’s liability shall be limited to either running the ad at an alternate appropriate time of similar value or refunding the cost of the non-played advertisement.

Payment Terms
Accounts will be paid on the terms agreed.  Credit cards incur a 2% fee.  Advertiser agrees that overdue accounts shall attract interest at a compounding rate of 2% per month until paid and further agrees to pay all costs of collection should accounts exceed 90 days unpaid, either $100 per invoice or actual costs if greater.  Unless otherwise specified, payments received shall be applied to oldest unpaid balances and fees first.  Returned checks shall incur a $40 per check fee
